his.). Defense of summary judgment obtained in putative class
action case alleging violations of federal "set-aside" requirements
under Federal statutes governing the Affordable Housing Disposition
Program
- Rocha v. Faltys, 69 S. W. 3d 315 (Tex. App. – Austin
2002, no pet. his.). Defense of “no duty” summary
judgment obtained in drowning case.
- Perry, et. al. v. S.N., et. al., 973 S.W. 2d 301 (Tex. 1998).
Defense of summary judgment in case of first impression before
Texas Supreme Court on question of whether provision of Texas
Family Code requiring certain professionals to report suspected
incidents of child abuse can be basis for negligence per se
cause of action
- Nash v. Perry, 944 S.W. 2d 728 (Tex. App. --Austin 1997,
writ granted); Perry, et. al. v. S.N., et. al., 973 S.W. 2d
301 (Tex. 1998). Defense of summary judgment in case of first
impression before Texas Supreme Court on question of whether
provision of Texas Family Code requiring certain professionals
to report suspected incidents of child abuse can be basis for
negligence per se cause of action.
- Brandon v. American Sterilizer Co., 880 S.W. 2d 488 (Tex.
App. -- Austin 1994, no writ). Defensive of favorable judgment
and directed verdict in product liability case presenting issues
regarding consumer standing under the Texas Deceptive Trade
Practices Act.
